You may be able to immigrate or adjust your status through a family member
 if your family member is:


• U.S. citizen
• Green Card holder (U.S. lawful permanent resident)
• Refugee or asylee
• Asylum seeker
• U Visa holder or applicant

FAMILY IMMIGRATION


Having a family member is a beginning, but it does not automatically mean that you can obtain status in the United States. It all depends on prior immigration history, who is your family member that can help you, financial status, prior criminal history, among other factors. ​

 

U.S. citizens can file an immigrant visa petition for their:

• Spouse
• Son or daughter
• Parent
• Brother or sister

U.S. Lawful Permanent Residents can only file an immigrant visa petition for their:

• Spouse
• Unmarried son or daughter

Refugees/Asylees can only file a petition for:

• Spouse
• Unmarried son or daughter under 21 years old

U visa holders/ applicants can only file a petition for:

• Spouse
• Unmarried son or daughter under 21 years old
